WHAT IS CLAIMS MANAGEMENT ?

Claims management is a claims process undertaken by one of the parties following a deviation from the planned execution of a contract.

WHAT CAN BE DONE IN AN ADVANCED STAGE OF LITIGATION (OR PRE-LITIGATION) ?

Lors de la prise de connaissance du projet, il est primordial d’étudier l’ensemble des pièces marché. Mais il faut également parcourir l’acte d’engagement, le CCAG (Cahier des Clauses Administratives Générales). Ou encore,  le CCTP (Cahier des Clauses Techniques Particulières), le calendrier des travaux (le planning), les annexes au contrat. Enfin, il est préférable de s’intéresser aux bons de commandes, aux rapports mensuels ainsi qu’aux situations financières.

Il est très important de prendre en compte l’ordre de précédence des documents contractuels. Ces informations sont en général prés établies dans l’acte d’engagement du marché ou alors dans le CCAG du marché.
